Apart from describing the general principles of the European patent system, the author presents both the provisions of the Directive 98/44/ECof 6 July 1998 and a new Chapter VI of the Implementing Regulations to the European Patent Convention. The analyses focus on the concept of patentable biotechnological inventions, scope of protection, exceptions to patentability. Certain special issues related to human genes as patentable subject matter are alsodiscussed.
