This privacy policy of the www.rcin.org.pl website (hereinafter referred to as: "Privacy Policy") determines, in particular, the conditions of use of the www.rcin.org.pl website by its visitors (hereinafter referred to as "User"), the principles of personal data processing and the issue of cookies used on the www.rcin.org.pl website.

 

1. General provisions                                                                         

1.1 This Privacy Policy regulates the use of the website www.rcin.org.pl by the User.

1.2 The administrator of the personal data collected via the website is Consortium RCIN, on behalf of which acts the Institute of Mathematics of the Polish Academy of Sciences with its seat in Warsaw 00-655, at Jana i Jędrzeja Śniadeckich 8, entered into the Register of Scientific Institutes kept by the Polish Academy of Sciences under number: RIN-III-19/98, NIP 5250008867, REGON: 000325860 (hereinafter referred to as the "Administrator").

1.3 The Administrator appointed a data protection officer, with whom the User can contact in all matters concerning personal data protection. The contact with the Data Protection Officer is possible in writing to the address of the DPO, Śniadeckich 8, 00-656 Warszawa or electronically to the e-mail address iod@impan.pl or by phone to 600-996-438.

1.4   The minimum technical requirements to be met in order to work with the ICT system used by the Administrator is to have a computer or other device connected to the Internet, equipped with an Internet browser: Mozilla Firefox version 17.0 and above or Internet Explorer version 10.0 and higher, Opera version 12.0 and higher, Google Chrome version 23.0. and above, Safari version 5.0 and above, Microsoft Edge version 25.10586.0.0 and above and access to e-mail, as well as enabling in the web browser the ability to save cookies and Javascript support. The Administrator recommends setting a minimum screen resolution of 1024x768.

1.5   Personal data of users of the www.rcin.org.pl website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: "GDPR"), as well as in accordance with the Act on Provision of Electronic Services of 18 July 2002. (Journal of Laws of 2017, item 459 as amended).

1.6   The Controller shall exercise particular care to protect the interests of data subjects, and in particular shall ensure that the data collected by it are processed lawfully, fairly and transparently, collected for specified, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes, adequate, relevant and limited to what is necessary for the purposes for which they are processed, correct and updated when necessary kept in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the data are processed, processed in a way which ensures appropriate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organizational measures.

 

2. Processing of personal data

2.1 The Administrator may process the Users' personal data if it is necessary for using the website www.rcin.org.pl or the services provided therein.

2.2 The purpose, scope and categories of recipients of the data processed by the Administrator will result from the actions taken each time by the User while using the website www.rcin.pl.

2.3  The possible purposes of processing the Users' personal data by the Administrator are defined below:

 2.3.1  Personal data concerning the e-mail address of a person who used the contact form available on the website www.rcin.org.pl will be processed in order to:

a)      to handle the inquiry sent and to communicate with that person in relation to their message sent via the contact form - on the basis of Article 6(1)(f) of the GDPR, i.e. on the basis of the legitimate interest pursued by the Administrator, which is communication with the person who initiated contact with the Administrator;

b)     b) to establish or assert claims or to defend against possible claims between the person who used the contact form and the Administrator - on the basis of Article 6(1)(f) GDPR i.e. on the basis of a legitimate interest pursued by the Administrator, which is the possibility to establish and assert claims and to defend against claims.

2.3.2 Personal data in the scope of the User's name (if it constitutes personal data) and email address of the person who uses the services consisting in setting-up and maintaining an account at the www.rcin.org.pl website will be processed in order to:

a)      to conclude an agreement with the Administrator for the provision of electronic services consisting in creating and maintaining an account on the www.rcin.org.pl website - on the basis of Article 6(1)(b) of the GDPR, i.e. the processing is necessary for the conclusion and performance of a contract (the subject of which is the provision of services provided by the Administrator) to which the person who ordered the service is a party or to take action at that person's request prior to concluding the contract;

b)     to establish or assert claims or to defend against claims between a person who uses the services consisting in creating and maintaining an account and the Administrator - on the basis of Article 6(1)(f) of the GDPR, i.e. on the basis of a legitimate interest pursued by the Administrator, which is to establish and assert claims and defend against claims.

2.3.3  Personal data of the www.rcin.org.pl website User obtained by means of cookies can be processed in order to:

a)      enable the User to use the www.rcin.org.pl website and the functionalities available on it - on the basis of Article 6(1)(b) of the GDPR, i.e. the processing is necessary for the conclusion and performance of an agreement (the subject of which is the provision of services by the Administrator) to which the person who ordered the service is a party or to take action at that person's request prior to entering into the agreement;

b)     to collect aggregatet statistics that allow the Administrator to understand how Users use the www.rcin.org.pl website and that help to administer the www.rcin.org.pl website and to improve its functionality and content - on the basis of Article 6(1)(a) of the GDPR, i.e. on the basis of the User's voluntary consent;

c)      establishing or pursuing claims or defending against possible claims between the www.rcin.org.pl website User and the Administrator - on the basis of Article 6(1)(f) GDPR, i.e. on the basis of a legitimate interest pursued by the Administrator, which is the possibility to establish and pursue claims and defend against claims.

2.4 Providing personal data is voluntary, but in each case it is necessary in order to use the services chosen by the User and provided by the Administrator (in case of failure to provide the relevant data, the Administrator will not be able to provide the services).

2.5  The User will not be subjected to automated decisions, including as a result of profiling.

2.6.The User's personal data will be processed for the period necessary to realize the purposes for which the data are processed (see 2.3) or until the User raises an objection (if the processing is based on the Administrator's lawful interest) - depending on which of these events occurs first.

2.7 Afterwards, the Administrator shall store them until the statute of limitations for any possible claims and for a period of two (2) months after the end of such applicable period of limitations.

2.8 Personal data processed by the Administrator shall be disclosed to the following entities: Administrator's employees and associates, IT service providers, hosting providers, entities providing consulting, legal, accounting services.

2.9 Personal data processed by the Administrator may be provided to entities and bodies authorized to process such data under the provisions of law.

2.10 The Administrator does not intend to transfer the personal data to a country outside the European Economic Area or to an international organization.

2.11 The Administrator may publish on the website www.rcin.org.pl commercial information, banners and links to other websites and other web services. By using a banner or a link, the User navigates to a website belonging to a different owner, who is entirely responsible for the content placed therein, as well as for processing personal data of visitors to the website.

 

3. Cookies and usage data.

3.1  HTTP Cookies (hereinafter: "Cookies") are computer data, in particular small information in the form of text files sent by a server and stored on the terminal equipment of the person visiting the website www.rcin.org.pl. 3.2  As a rule, cookies themselves do not constitute personal data, however, certain information stored in cookies (e.g. regarding preferences), especially when combined with other information about the User, may be treated as personal data. Personal data collected using Cookies may only be processed for the purpose of performing certain functions related to making the www.rcin.org.pl website available to the User, as referred to below. Such data are encrypted in a way that prevents access by unauthorized persons. In a situation where data collected by means of cookies constitute personal data, the Administrator processes them only on the legal grounds provided for in GDPR, as referred to in point 2.3 above.

3.3  The following Cookies are used within the www.rcin.org.pl website:

3.3.1  Cookies files of the Administrator:

a) session files - are temporary files, they remain stored on the User's computer or mobile device until logging off from the website, leaving the website or switching off the software (web browser);

b) permanent - they remain on the User's device for the time specified in the parameters of cookies or until they are manually deleted by the User in the web browser;

3.3.2 Cookies of third parties.

3.4 The Administrator may process data (including personal data) contained in Cookies when Users use the www.rcin.org.plw website for the following purposes:

3.4.1 Enabling the Administrator to administer the www.rcin.org.pl website, in particular by collecting data in the form of server logs;

3.4.2 Enabling the User to use the www.rcin.org.pl website and the functionalities available therein;

3.4.3 Collect aggregate statistics which allow the Administrator to understand how Users use the www.rcin.org.pl website and which help to administer the www.rcin.org.pl website and to improve its functionality and content.

3.5 Each visit to the www.rcin.org.pl website is connected with sending a request to the server, on which the website is located. Each query sent to the server is recorded in the server logs. Server logs contain, among other things, User's IP address, date and time of the event, information about the Internet browser and operating system the User is using. This information is saved and stored on the server used by the Administrator. The data saved in the server logs are not associated with specific persons using the www.rcin.org.pl website and are not used to identify the User. Server logs are used as an aid in administering the www.rcin.org.pl website and their content is not disclosed to anyone except persons authorized to administer the server.

Thus, the user can partially restrict (e.g. temporarily) or completely disable the storage of cookies - in the latter case, however, this may affect certain functionalities of the website www.rcin.org.pl.

3.9 The settings of the Internet browser regarding cookies are important from the point of view of consent to the use of cookies by the Administrator - according to the regulations, consent to the use of cookies which do not contain personal data can also be expressed through the settings of the Internet browser. If such consent is not given, the settings of the Internet browser concerning cookies should be changed accordingly.

4. Rights related to data processing

 4.1 Provision of data by the Users is voluntary, but to a certain extent (depending on the actions taken each time by the User while using the www.rcin.org.pl website) it is necessary to use the www.rcin.org.pl website.

 4.2 The User has:

 4.2.1 The right to access their personal data;

4.2.2 The right to request its correction;

4.2.3 The right to request their deletion;

4.2.4 The right to request restriction of their processing;

4.2.5 The right to data portability, i.e. to receive personal data from the Administrator in a structured, commonly used and machine-readable format. The user may also request the Controller to send personal data that previously provided to another controller;

4.2.6 To the extent that the processing of one’s personal data is based on a legitimate interest of the Administrator, the user has the right to object to the processing of personal data.

4.3 If the User gives his/her consent to the processing of data, he/she shall have the right to revoke the consent at any time, without affecting the legality of the processing performed on the basis of the consent prior to its revocation.

 4.4 In order to exercise the above rights, the User shall contact the Administrator using the contact data indicated above (contact data indicated above in Section 1.2).

 4.5 Moreover, the User has the right to lodge a complaint to the supervisory authority dealing with personal data protection (the President of the Office for Personal Data Protection), if the User believes that the processing of data violates the GDPR.  5. Copyright

 5.1   All materials, graphic elements, the layout and composition of these elements (layout), trademarks, other information that are available on the website www.rcin.org.pl are subject to copyright, unless otherwise expressly indicated for a given object.

5.2   Downloading or use in any extent of the objects contained in the Administrator's repository resources available on the website www.rcin.org.pl is regulated in detail in the Terms of Service of the website.

5.3   Downloading or use of the objects contained in the Administrator's repository resources cannot violate the Privacy Policy, the Terms of Service of the www.rcin.org.pl website, generally applicable laws, as well as the interests of the Administrator or any third parties.

5.4   All graphic elements, their arrangement and composition (layout), trademarks, other information, technical solutions and other elements of the www.rcin.org.pl website (not being objects contained in the Administrator's repository resources and made available to Users on the terms specified in the Rules for Providing Services via the www.rcin.org.pl website), in particular the HTML and XHTML code, CSS sheets, JavaScript scripts and multimedia links, are the subject of exclusive rights of the Administrator and are protected by the Administrator's copyright. Downloading or using in any extent these materials requires explicit consent of the Administrator.

5.5   The contents placed within the www.rcin.org.pl website are protected by copyright law. The User shall be fully liable for any damage caused to the Administrator or any third party resulting from the use of any content without the Administrator's consent or in a way inconsistent with the provisions of the Terms of Service of the www.rcin.org.pl website.

 

6. Modification of the Privacy Policy

6.1 The Administrator may change the Privacy Policy and the formula for using the website www.rcin.org.pl if at least one of the important reasons indicated in the catalog below occurs:

6.1.1 a change in the provisions of the applicable law that governs the Administrator's business;

6.1.2. the need to adjust the content of the Privacy Policy to the applicable law or the need to make editorial changes to the Privacy Policy

6.1.3. change in the way the www.rcin.org.pl website is maintained or operates, which will be caused by objective and independent reasons of technological or technical nature

6.1.4. change of the conditions of use of the www.rcin.org.pl website, which will not worsen the situation of the Users in comparison to the existing ones;

6.1.5. the need to update the Administrator's data indicated in the Privacy Policy.

 

7. Final provisions

 7.1 The website www.rcin.org.pl may contain links to other websites. The Administrator suggests that once connected to these other websites, please read the privacy policies of these other websites. This Privacy Policy applies only to the website www.rcin.org.pl.

7.2 The Administrator shall apply technical and organizational measures to ensure the protection of the processed personal data appropriate to the threats and the category of data protected, and in particular it shall protect the data against their disclosure to unauthorized persons, taking by an unauthorized person, processing in violation of the aplicable regulations and against change, loss, damage or destruction.

7.3 The Administrator shall secure the data file against unauthorized access.

 7.4 In matters not regulated in this Privacy Policy, the provisions of the Civil Code Act of 23 April 1964 (i.e. 16 May 2019, Journal of Laws of 2019, item 1145) shall apply complementarily.
